Abdul Aziz, the Complainant, being the resident manager “Jang Group of Newspapers”, filed a case against the editor of “Daily Tulou” alleging that the material published by the Daily Tulou accounted to defamation of the Jang Group of newspaper, its CEO and Geo Television Network. It was argued that the complaint filed by Abdul Aziz was not maintainable, as the Complainant was not an aggrieved person, Literal dictionary meaning of an aggrieved person was looked upon which states: “one whose legal right has been invaded.”
However, Abdul Aziz claimed that due to defamatory material printed in the newspaper not only the Jang group of Newspaper had suffered loss, but Abdul Aziz in his personal capacity had also been defamed. Hence the Complainant was able to prove himself as an aggrieved person under section 198 of Criminal Procedure Code
